that it was a tom Petty song

That comparison MP3 isn't quite fair; the tempo on the Petty track is sped up. Pretty obvious if anyone knows the track. However, the progression and meter seem reaaaaly similar and I don't like RHCP, so I hope they either get busted or die in a scuba diving / whaling accident.

influenced, sure. But it is totally unfair to be able to use a chord progression and melody that are almost exactly the same.

Judas, to what you're saying, things with the same chord progression doesn't mean one copied the other. The 12 bar blues is a common chord progression that is used in COUNTLESS songs. Hell, Ray Charles built his whole career off the 12 bar blues. When you are "heavily influenced" by multiple aspects, it calls for some legal action imo.
