i wouldnt kill anyone who broke into my house, only if they just threatened me or my family. if the dude is just looking for shit to steal, ill just beat his ass and hold him for the cops. i would kill him in self defense. thats why they use the term excessive force. you cant shoot someone to death if he you knock his ass out or if he falls off your roof and breaks his leg.
